Términos y Condiciones de Uso

Los presentes Términos y Condiciones (en adelante, los «Términos») regulan el acceso y la utilización del sitio web trackprop.io y de su panel de control (en adelante, conjuntamente, «TrackProp.io», la «Plataforma» o el «Servicio»). El registro en la Plataforma o su utilización implican la aceptación plena de estos Términos y de la Política de Privacidad. Quien no esté conforme con ellos deberá abstenerse de utilizar el Servicio.

1. Objeto del Servicio

TrackProp.io es una herramienta de software destinada al registro, la organización y el análisis de la actividad del Usuario con empresas de fondeo (prop firms), incluyendo cuentas, evaluaciones, costes, retiros (payouts) y métricas de rendimiento. Los datos son introducidos por el propio Usuario; el Servicio se limita a organizarlos y presentarlos.

TrackProp.io no presta servicios de asesoramiento financiero, de inversión, fiscal ni jurídico. Ninguna información, métrica o contenido mostrado por la Plataforma constituye una recomendación de operar, invertir o contratar producto alguno. Las decisiones del Usuario son de su exclusiva responsabilidad. TrackProp.io no será responsable de las pérdidas derivadas de la actividad de trading o de inversión del Usuario.

TrackProp.io no es una empresa de fondeo ni mantiene vinculación con ninguna. Las denominaciones de las empresas de fondeo mencionadas son marcas de sus respectivos titulares y se utilizan únicamente con fines identificativos.

2. Fase beta y modificaciones del Servicio

El Servicio se encuentra en fase beta. El acceso podrá estar limitado o sujeto a aprobación previa, y determinadas funcionalidades podrán modificarse, presentar errores o dejar de estar disponibles durante su desarrollo.

TrackProp.io se reserva el derecho a añadir, modificar o retirar funcionalidades. Cuando una modificación afecte de forma sustancial a las prestaciones de un plan de pago, se informará al Usuario con una antelación razonable.

3. Registro y cuenta de usuario

Para registrarse, el Usuario deberá ser mayor de dieciséis (16) años y facilitar información veraz y actualizada. El Usuario es responsable de la custodia de sus credenciales de acceso y de toda la actividad realizada desde su cuenta, y deberá comunicar sin demora a hola@trackprop.io cualquier acceso no autorizado del que tenga conocimiento.

La cuenta es personal e intransferible y no podrá compartirse ni cederse a terceros.

4. Planes, precios y condiciones de pago

4.1. Planes

La Plataforma ofrece un plan gratuito con funcionalidades limitadas y un plan de pago (Pro) en las siguientes modalidades:

Los precios incluyen el IVA u otros impuestos indirectos aplicables en función del país del Usuario. El importe final se muestra antes de la confirmación del pago. Los pagos se procesan a través de Stripe.

4.2. Renovación automática

Las suscripciones se renuevan automáticamente al término de cada periodo, mensual o anual, por el mismo importe, salvo cancelación previa. Cualquier modificación de precio se comunicará con anterioridad a la siguiente renovación, pudiendo el Usuario cancelar la suscripción en caso de disconformidad.

4.3. Cancelación

El Usuario podrá cancelar su suscripción en cualquier momento mediante solicitud remitida a hola@trackprop.io desde la dirección de email asociada a su cuenta. Para evitar el cargo de la siguiente renovación, la solicitud deberá recibirse antes del inicio del nuevo periodo. Tras la cancelación, el Usuario conservará el plan Pro hasta la finalización del periodo abonado, momento en el que su cuenta pasará al plan gratuito. Salvo en los supuestos previstos en el apartado 4.4 o cuando la ley disponga otra cosa, no se reembolsarán los periodos ya iniciados.

4.4. Derecho de desistimiento

El Usuario que tenga la condición de consumidor dispone de un plazo de catorce (14) días naturales desde la contratación para desistir sin necesidad de justificación, mediante comunicación dirigida a hola@trackprop.io. Dado que la prestación del Servicio comienza en el momento de la contratación, en caso de desistimiento se reembolsará el importe abonado, deducida la parte proporcional correspondiente al periodo ya disfrutado. El reembolso se efectuará a través del mismo medio de pago utilizado, en un plazo máximo de catorce (14) días.

5. Programa de partners

Los partners podrán recomendar TrackProp.io mediante un enlace o código propio. Las comisiones, sus porcentajes, los importes mínimos de liquidación, la duración y las demás condiciones se establecen en el acuerdo individual suscrito con cada partner, que prevalecerá sobre estos Términos en las materias que regule.

Los usuarios que se registren a través del enlace de un partner podrán beneficiarse del descuento vigente en cada momento.

Quedan prohibidos el auto-referido, el envío de comunicaciones no solicitadas y la promoción engañosa de TrackProp.io. En caso de uso fraudulento o abusivo, TrackProp.io podrá anular las comisiones afectadas y dar por terminada la participación en el programa.

6. Normas de uso

El Usuario se compromete a no:

  1. Utilizar el Servicio con fines ilícitos o lesivos de derechos de terceros.
  2. Intentar acceder a cuentas o datos de otros usuarios, o a áreas del sistema no abiertas al público.
  3. Interferir en el funcionamiento del Servicio, incluyendo su sobrecarga, la introducción de código malicioso o el acceso automatizado abusivo.
  4. Copiar, revender o explotar comercialmente el Servicio sin autorización previa.
  5. Aportar información falsa para figurar en el leaderboard o en el proceso Verified Trail, o publicar contenido ilícito u ofensivo.

7. Datos introducidos por el Usuario

Los datos de trading, certificados e imágenes introducidos por el Usuario le pertenecen y se incorporan bajo su exclusiva responsabilidad. El Usuario garantiza su exactitud y la titularidad de los derechos necesarios para aportarlos.

TrackProp.io no verifica los datos introducidos, salvo en el proceso Verified Trail. Las métricas se calculan a partir de dichos datos, por lo que su exactitud depende de la información aportada por el Usuario.

El Usuario autoriza a TrackProp.io a almacenar y tratar dichos datos con la única finalidad de prestar el Servicio. El Usuario podrá exportarlos desde el panel de control y eliminarlos en cualquier momento. El tratamiento de los datos personales se rige por la Política de Privacidad.

8. Exclusión y limitación de responsabilidad

TrackProp.io no será responsable, en ningún caso, de las pérdidas derivadas de la actividad de trading o de inversión del Usuario. TrackProp.io es una herramienta de registro y análisis: no ejecuta operaciones, no gestiona capital y no presta asesoramiento. Todas las decisiones de trading e inversión, y sus resultados, son responsabilidad exclusiva del Usuario.

El Servicio se presta en el estado en que se encuentra y según su disponibilidad. TrackProp.io no garantiza la ausencia de errores o interrupciones ni la exactitud de los cálculos en todos los supuestos.

TrackProp.io tampoco será responsable del lucro cesante, de la pérdida de oportunidades de negocio ni de los daños indirectos. Su responsabilidad total frente al Usuario quedará limitada al importe abonado por el Servicio en los doce (12) meses anteriores al hecho que la origine.

Lo anterior se entiende sin perjuicio de los derechos que la normativa de protección de los consumidores reconozca al Usuario.

9. Propiedad intelectual e industrial

El software, el diseño, los textos, la marca TrackProp.io, los logotipos y los demás elementos de la Plataforma son titularidad de TrackProp.io o de sus licenciantes y están protegidos por la normativa de propiedad intelectual e industrial. Se concede al Usuario una licencia de uso personal, limitada, no exclusiva e intransferible, exclusivamente para utilizar el Servicio conforme a estos Términos. No se transfiere ningún otro derecho.

10. Suspensión y terminación

El Usuario podrá dejar de utilizar el Servicio y solicitar la baja de su cuenta en cualquier momento.

TrackProp.io podrá suspender o cancelar la cuenta del Usuario en caso de incumplimiento de estos Términos, por exigencia legal o cuando su uso comprometa la seguridad del Servicio o de otros usuarios. Salvo en supuestos graves o urgentes, se notificará previamente al Usuario con indicación del motivo.

En caso de cese definitivo del Servicio, se informará con antelación suficiente para que el Usuario pueda exportar sus datos, y se reembolsará la parte proporcional de los periodos abonados y no disfrutados.

11. Modificación de los Términos

TrackProp.io podrá modificar estos Términos. La versión vigente se publicará en esta página con indicación de su fecha. Cuando las modificaciones sean relevantes, se comunicarán por email o a través del panel de control antes de su entrada en vigor. La utilización del Servicio con posterioridad implicará su aceptación; en caso de disconformidad, el Usuario podrá cancelar su suscripción y solicitar la baja de su cuenta.

12. Legislación aplicable

Estos Términos se interpretarán conforme a la legislación aplicable de la jurisdicción de operación de TrackProp.io, sin perjuicio de los derechos imperativos que asistan a los consumidores.

These Terms and Conditions (hereinafter, the “Terms”) govern access to and use of the website trackprop.io and its dashboard (hereinafter, collectively, “TrackProp.io”, the “Platform” or the “Service”). Registering on the Platform or using it constitutes full acceptance of these Terms and of the Privacy Policy. Anyone who does not agree with them must refrain from using the Service.

1. Purpose of the Service

TrackProp.io is a software tool intended for recording, organising and analysing the User’s activity with proprietary trading firms (prop firms), including accounts, evaluations, costs, withdrawals (payouts) and performance metrics. The data are entered by the User; the Service merely organises and presents them.

TrackProp.io does not provide financial, investment, tax or legal advisory services. No information, metric or content displayed by the Platform constitutes a recommendation to trade, invest or purchase any product. The User’s decisions are the User’s sole responsibility. TrackProp.io shall not be liable for any losses arising from the User’s trading or investment activity.

TrackProp.io is not a prop firm and has no affiliation with any prop firm. The names of the prop firms mentioned are trademarks of their respective owners and are used solely for identification purposes.

2. Beta phase and changes to the Service

The Service is in its beta phase. Access may be limited or subject to prior approval, and certain features may change, contain errors or cease to be available during their development.

TrackProp.io reserves the right to add, modify or withdraw features. Where a change substantially affects the features of a paid plan, the User will be informed with reasonable advance notice.

3. Registration and user account

To register, the User must be over sixteen (16) years of age and provide truthful and up-to-date information. The User is responsible for safeguarding their access credentials and for all activity carried out from their account, and must notify hola@trackprop.io without delay of any unauthorised access of which they become aware.

The account is personal and non-transferable and may not be shared with or assigned to third parties.

4. Plans, prices and payment terms

4.1. Plans

The Platform offers a free plan with limited features and a paid plan (Pro) in the following options:

Prices include VAT or other indirect taxes applicable according to the User’s country. The final amount is shown before the payment is confirmed. Payments are processed through Stripe.

4.2. Automatic renewal

Subscriptions renew automatically at the end of each period, monthly or annual, for the same amount, unless cancelled beforehand. Any price change will be communicated before the next renewal, and the User may cancel the subscription if they do not agree.

4.3. Cancellation

The User may cancel their subscription at any time by sending a request to hola@trackprop.io from the email address associated with their account. To avoid being charged for the next renewal, the request must be received before the new period begins. After cancellation, the User will retain the Pro plan until the end of the paid period, at which point their account will move to the free plan. Except in the cases provided for in section 4.4 or where the law provides otherwise, periods that have already begun will not be refunded.

4.4. Right of withdrawal

A User who qualifies as a consumer has a period of fourteen (14) calendar days from the date of purchase to withdraw without giving any reason, by notice sent to hola@trackprop.io. Since provision of the Service begins at the time of purchase, in the event of withdrawal the amount paid will be refunded, less the proportional part corresponding to the period already enjoyed. The refund will be made using the same means of payment, within a maximum of fourteen (14) days.

5. Partner programme

Partners may recommend TrackProp.io through their own link or code. Commissions, their percentages, minimum payout amounts, duration and all other conditions are set out in the individual agreement entered into with each partner, which shall prevail over these Terms in the matters it governs.

Users who register through a partner’s link may benefit from the discount in force at any given time.

Self-referral, the sending of unsolicited communications and misleading promotion of TrackProp.io are prohibited. In the event of fraudulent or abusive use, TrackProp.io may cancel the commissions concerned and terminate participation in the programme.

6. Rules of use

The User undertakes not to:

  1. Use the Service for unlawful purposes or in a manner that infringes the rights of third parties.
  2. Attempt to access other users’ accounts or data, or areas of the system not open to the public.
  3. Interfere with the operation of the Service, including overloading it, introducing malicious code or abusive automated access.
  4. Copy, resell or commercially exploit the Service without prior authorisation.
  5. Provide false information in order to appear on the leaderboard or in the Verified Trail process, or publish unlawful or offensive content.

7. Data entered by the User

The trading data, certificates and images entered by the User belong to the User and are entered under the User’s sole responsibility. The User warrants their accuracy and that they hold the rights necessary to provide them.

TrackProp.io does not verify the data entered, except in the Verified Trail process. Metrics are calculated from such data, so their accuracy depends on the information provided by the User.

The User authorises TrackProp.io to store and process such data for the sole purpose of providing the Service. The User may export them from the dashboard and delete them at any time. The processing of personal data is governed by the Privacy Policy.

8. Exclusion and limitation of liability

TrackProp.io shall not, under any circumstances, be liable for any losses arising from the User’s trading or investment activity. TrackProp.io is a recording and analysis tool: it does not execute trades, does not manage capital and does not provide advice. All trading and investment decisions, and their outcomes, are the sole responsibility of the User.

The Service is provided on an “as is” and “as available” basis. TrackProp.io does not guarantee that the Service will be free from errors or interruptions, nor that calculations will be accurate in all cases.

Nor shall TrackProp.io be liable for loss of profits, loss of business opportunities or indirect damages. Its total liability to the User shall be limited to the amount paid for the Service in the twelve (12) months preceding the event giving rise to it.

The foregoing is without prejudice to the rights granted to the User under consumer protection legislation.

9. Intellectual and industrial property

The software, design, texts, the TrackProp.io brand, logos and all other elements of the Platform are owned by TrackProp.io or its licensors and are protected by intellectual and industrial property legislation. The User is granted a personal, limited, non-exclusive and non-transferable licence solely to use the Service in accordance with these Terms. No other rights are transferred.

10. Suspension and termination

The User may stop using the Service and request the closure of their account at any time.

TrackProp.io may suspend or cancel the User’s account in the event of a breach of these Terms, where required by law, or where its use compromises the security of the Service or of other users. Except in serious or urgent cases, the User will be notified in advance and informed of the reason.

In the event of the definitive discontinuation of the Service, sufficient advance notice will be given so that the User can export their data, and the proportional part of periods paid for but not enjoyed will be refunded.

11. Amendments to the Terms

TrackProp.io may amend these Terms. The version in force will be published on this page together with its date. Where the amendments are material, they will be communicated by email or through the dashboard before they take effect. Continued use of the Service thereafter shall constitute acceptance; if the User does not agree, the User may cancel their subscription and request the closure of their account.

12. Governing law

These Terms shall be interpreted in accordance with the applicable law of the jurisdiction in which TrackProp.io operates, without prejudice to the mandatory rights of consumers.
